With written authorization from the seller, the investor will do ALL the negotiating with the bank, and over 90% of the time can get the bank to waive deficiency judgments and/or promissory notes.
There are NO fees charged to the seller by the investor. The investor makes his money by reselling the home later for a profit (though still less than what is currently owed), and this is all disclosed to the seller’s bank up front. The investor is already approved as a buyer by large banks like Bank of America and Wells Fargo, and is able to complete the short sale process quickly.
What is required from the seller?
- Authorization for the investor to negotiate on the seller’s behalf with their bank. Terms that are acceptable to the seller will be agreed upon in the sales contract with the investor prior to the negotiations.
- Seller to complete the bank’s short sale forms and provide all documentation on income and debt required by the bank. The investor will provide a list to the seller of all required documents and the investor will complete the package to be submitted to the bank.
- Allow the investor to put the home on the market with the investor’s licensed Realtor at a price to be determined by the investor. The seller will give easy access for the home to be shown to other prospective purchasers who would buy the home directly from the investor only after the investor has first closed escrow with the seller.
